Terms of Service

This Agreement governs your access to and use of ApproveMyVisa. By using our platform, you accept these Terms in full. Please read carefully before proceeding.

1 Acceptance of Terms

These Terms of Service ("Terms") are a legally binding contract between you and ApproveMyVisa, a Canadian Registered Corporation. By accessing, registering for, purchasing from, or using the ApproveMyVisa platform at www.approvemyvisa.com, you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform. We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting.

2 About ApproveMyVisa

ApproveMyVisa is an AI-powered information platform providing general immigration guidance and document preparation assistance for visa applications across multiple countries including the UK, Canada, USA, Schengen Area, UAE, Australia, Germany, Ireland, New Zealand, Portugal, Spain, and Italy.

ApproveMyVisa is not affiliated with, endorsed by, or connected to any government, immigration authority, embassy, consulate, or official government body in any country. We have no influence over government decisions, processing times, or application outcomes.

THE INFORMATION, CONTENT, DOCUMENTS, CHECKLISTS, AI RESPONSES, ANALYSIS, GUIDANCE, AND ALL OTHER MATERIALS PROVIDED BY APPROVEMYVISA DO NOT CONSTITUTE LEGAL ADVICE, IMMIGRATION LEGAL ADVICE, PROFESSIONAL LEGAL COUNSEL, OR ANY FORM OF REGULATED PROFESSIONAL ADVICE.

ApproveMyVisa is not a law firm, immigration attorney, RCIC, licensed solicitor, barrister, or any other type of licensed professional in any jurisdiction. No attorney-client relationship or professional advisory relationship is created by your use of the Platform.

You are solely responsible for independently verifying all immigration information through official government sources before making any decision, submitting any application, or taking any action.

4 No Guarantee of Results

ApproveMyVisa makes no representation, warranty, promise, or guarantee of any kind regarding any immigration outcome, including visa approval, residency grants, refusal reversals, Express Entry invitations, or any other government decision. All immigration decisions are made exclusively by relevant government authorities in their sole and absolute discretion.

The Protected Parties accept no responsibility or liability whatsoever for any visa refusal, rejection, delay, ban, or any other adverse immigration outcome, regardless of whether you used our services or followed our guidance.

5 Services Description

The Platform provides the following for general informational and document preparation purposes only:

  • AI-generated immigration information and guidance
  • Document checklist generation based on user-provided information
  • Cover letter and personal statement drafting assistance
  • Visa refusal letter analysis and plain-English interpretation
  • Canada Express Entry CRS points estimation
  • Retirement migration information for Portugal, Spain, Italy, and other destinations
  • Blog articles, educational content, and general informational resources

All services are for general informational purposes only and are not a substitute for qualified professional legal advice or representation before any government authority.

6 User Responsibilities

You represent and warrant that all information you provide is accurate, complete, and truthful. You are solely responsible for independently verifying all immigration requirements through official government sources before taking any action. You will use the Platform only for lawful purposes and confirm that you are at least 18 years of age with legal capacity to enter this Agreement.

7 Accounts and Registration

By creating an account, you agree to provide accurate registration information, maintain the confidentiality of your credentials, and accept full responsibility for all activity under your account. You may not share, transfer, or assign your account to any third party. We reserve the right to suspend or terminate any account at any time without notice for any reason including violation of these Terms.

8 Payment Terms and Refund Policy

Payment Processing

All payments are processed by Stripe. All prices are displayed in Canadian Dollars (CAD). Each package provides 60-day access for one application. We reserve the right to change pricing at any time.

Non-Refundable Digital Services

The following are non-refundable once accessed or delivered: AI-generated checklists, cover letters, guidance packages, refusal analyses, and plan access once activated on your account.

No Refunds for Government Outcomes

No refund will be issued on the basis of any visa refusal, rejection, delay, change in personal circumstances, or any adverse government decision.

Chargeback Policy

You agree to contact us at [email protected] before initiating any chargeback. Initiating a chargeback without first contacting us constitutes a material breach of this Agreement.

9 Intellectual Property

All content, materials, features, and technology on the Platform are the exclusive proprietary property of ApproveMyVisa or its licensors, protected by applicable intellectual property laws. You may not copy, reproduce, scrape, reverse engineer, resell, or commercialize any Platform content or generated materials without written permission. Documents generated for your personal use may be used solely for your own individual immigration application.

10 Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY LIMITS THE LIABILITY OF APPROVEMYVISA AND ALLOCATES RISK TO YOU.

You expressly acknowledge that your use of the Platform is entirely at your own risk. To the absolute fullest extent permitted by applicable law, the Protected Parties shall have no liability whatsoever for any loss, damage, or harm arising out of your use of the Platform, including any visa refusal or adverse government decision, direct or consequential damages, financial losses, errors in AI-generated content, or platform unavailability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ALL PROTECTED PARTIES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

11 Indemnification

You agree to fully defend, indemnify, and hold harmless the Protected Parties from any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, your violation of any applicable law, or your reliance on Platform content for any decision or action.

Release of Claims

To the fullest extent permitted by applicable law, you hereby release, waive, and forever discharge the Protected Parties from any and all claims arising out of or connected with your use of the Platform or any immigration outcome.

12 Third-Party Services

The Platform integrates with third-party services that are entirely independent of ApproveMyVisa. We make no representation or warranty regarding any third-party service. We are not responsible for any content, privacy practices, or decisions of any third party. Your use of any third-party service is at your sole risk.

13 Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES, CONTENT, TOOLS, AND AI-GENERATED MATERIALS ARE PROVIDED STRICTLY ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS WITHOUT WARRANTIES OF ANY KIND. APPROVEMYVISA EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; AND WARRANTIES REGARDING THE ACCURACY OF ANY CONTENT OR AI-GENERATED OUTPUT.

14 Prohibited Conduct

You agree not to use the Platform to: violate any applicable law; assist in preparing fraudulent or deceptive immigration applications; misrepresent your identity or eligibility to any government authority; scrape or extract data from the Platform; use automated tools to access the Platform; interfere with or damage Platform infrastructure; or resell Platform services without written authorization.

15 Termination and Suspension

We reserve the right to suspend, restrict, or permanently terminate your access to the Platform at any time, immediately and without prior notice, for any reason. Upon termination, all licenses and rights granted to you immediately expire. Provisions that by their nature survive termination shall survive indefinitely.

16 Content, Accuracy and Changes

Immigration laws and requirements change frequently without notice. We cannot guarantee that all information is accurate or up to date. AI-generated content may contain errors, omissions, or outdated information. We reserve the right to modify, update, remove, or discontinue any content, service, feature, or pricing at any time without notice.

17 Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and applicable federal laws of Canada. You consent to the exclusive jurisdiction of the courts of Alberta, Canada. Before initiating any formal proceeding, you agree to first contact us and allow 30 days for good-faith informal resolution.

Class Action Waiver

You waive any right to bring or participate in any class action, collective action, or representative proceeding against ApproveMyVisa. All claims must be brought in your individual capacity only.

Limitation Period

Any claim must be commenced within one (1) year after the event giving rise to the claim, after which such claim is permanently time-barred.

18 General Provisions

Severability: If any provision is held invalid, the remaining provisions continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ApproveMyVisa.

No Waiver: Our failure to enforce any right shall not constitute a waiver of that right.

Assignment: We may assign these Terms without restriction. You may not assign your rights without our prior written consent.

Force Majeure: ApproveMyVisa is not liable for any failure resulting from causes beyond our reasonable control including government actions, pandemics, natural disasters, or cyber attacks.
